Fundación Telefónica maintains its commitment to respect the privacy of users and the confidentiality of personal data, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), and in Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, hereinafter referred to as the “Applicable Regulations”.

Your privacy and the security of your data are our priority, as set out in the Fundación Telefónica Business Principles, which inspire and define the way in which Fundación Telefónica carries out its activity. On this basis, Fundación Telefónica will process your personal data in accordance with the following principles:

Transparency

Fundación Telefónica is 100% transparent with you about the data we collect and/or process about you and we explain why we use it and for what purposes. We will not process your data in an unexpected, opaque, or improper manner.

Control

You are the only person who can control how your data is used. We will provide you with the tools so that you can decide at any time how you want us to handle your data, up to when and how you can access and update your personal information.

Security

Fundación Telefónica is committed to guaranteeing the security, secrecy and confidentiality of your data and personal information. We have carried out the necessary analysis and risk assessments in accordance with the best security and privacy standards in order to implement the most stringent and robust security measures to prevent the loss, alteration, misuse or unauthorised access to your data.

Please note that this Privacy Policy applies when you use the functionalities (hereinafter, the «Functionalities») offered through the platforms owned by Fundación Telefónica (hereinafter, collectively, the «Platform»).

Depending on how you access the Platform, you will be considered a registered user (hereinafter, «Users» or «User»), if you create a personal profile, or as a visitor, if you browse the Platform or access any of the Functionalities that do not require prior registration on the Platform (hereinafter, «Visitors» or «Visitor»).

In short, and by means of this Privacy Policy, which we encourage you to read carefully, Fundación Telefónica wishes to inform you how and by whom your personal data will be processed when you make use of the Platform’s Functionalities.

3.1 Data you provide directly to Fundación Telefónica

During your registration process and creation of a User account on any Platform, as well as when you enjoy some of its Functionalities, we will obtain personal data directly from you.

In this case, all information you provide as a User must be truthful and accurate. For these purposes, the User warrants as to the authenticity of all data provided as a result of filling in the corresponding forms. The User shall be solely responsible for any false or inaccurate statements made, and for any damage caused to Fundación Telefónica, or to third parties, as a result of the information provided.

In the event of the provision of false data or data that do not correspond to the account holder, Fundación Telefónica reserves the right to cancel the User’s account and/or to take such measures as it deems appropriate for the best defence of its interests and rights, or those of affected third parties who may be affected as a result of the foregoing.

Fundación Telefónica reserves the right to verify the information provided by the User by any means that may be appropriate for the purposes of control and/or verification, depending on the state of the art at any given time and what is most appropriate for the protection of the interests and rights of the parties involved.

If the User provides personal data of third parties through the functionalities that, where applicable, are available on the Platform, said User shall be obliged to inform them of said processing as detailed in this privacy policy and that their data will be provided to Fundación Telefónica for these purposes, and the User shall be exclusively and fully liable in the event of any breach in this regard. Fundación Telefónica shall therefore be exempt from any liability in this area.
3.2 Depending on your use of the Functionalities

We may record data about your use of the Platform, depending on the Features you use, what content you access, which third party publications you click on or whether you are redirected via the Platform to third-party sites online.

3.3 Cookies

You can see in our Cookie Policy how we use cookies and similar technologies (SDKs, pixels, tags, beacons, etc.), where appropriate, to collect information about you and the device with which you access the Platform. You can configure the cookies through the specific settings section provided for this purpose, so that only those that are strictly necessary to ensure the proper enjoyment of the Functionalities are enabled.

4. WHAT IS THE LEGITIMATE BASIS FOR THE PROCESSING OF YOUR DATA?

The legitimate basis for Fundación Telefónica’s processing of your personal data will be duly detailed in the specific conditions that govern in each case, according to each purpose of processing (as detailed in this Privacy Policy), with the following cases being differentiated:

Express consent

You will be able to provide, normally by means of a form, the specific data requested by Fundación Telefónica, which will be strictly necessary for the purpose for which they are collected. Prior to granting such consent, you will be informed of the identity of the data controller, its purpose, legal basis, rights that you may exercise, possible transfers to third parties, storage periods for such data, as well as whether there will be, where appropriate, international transfers. Your personal data will only be processed in accordance with the specific purpose for which they were collected.

You may withdraw your consent to such processing in accordance with the provisions of the «Exercise of Rights» section of this Privacy Policy.

Legitimate interest

This case constitutes a legitimate basis for processing, provided that this interest has been adequately weighed, in advance, by Fundación Telefónica. The right to object to processing operations based on this legitimate basis may be exercised by sending the relevant notification to the addresses listed in the «Exercise of Rights» section of this Privacy Policy.

Compliance with a legal obligation

In this case, and on the basis of a legal obligation applicable to Fundación Telefónica, as the data controller, the latter will be authorised to process your personal data.

Performance of a contract

Within the framework of the Platform and the Functionalities, the implementation of the Terms of Use will authorise Fundación Telefónica to process your personal data.

5. HOW LONG IS THE DATA RETAINED?

In general, we will retain your data for the time necessary to fulfil the purpose described in each processing activity and to determine any liability that may arise from that purpose.

In any event, your data will be retained in accordance with the retention criteria or specific periods outlined in each data processing activity and, as appropriate, until you withdraw consent and/or object to the processing of the data. In this regard, we will do our best to provide you with an automatic, simple mechanism for you to withdraw the consent granted and/or to object to the processing and, in any case, we are at your disposal at the mailing address for exercising your rights as indicated in section 7 of this Policy.

Once the aforementioned retention periods have expired, set out in section 10 of this Privacy Policy, we will block your personal data for the limitation period of legal actions and, once this period has expired, we will go ahead with its definitive erasure in accordance with the applicable regulations, and/or to its secure anonymisation by Fundación Telefónica.

6. WHO IS THE RECIPIENT OF THE DATA? ARE THERE ANY INTERNATIONAL DATA TRANSFERS?

Third parties who may access, receive and process your data

On a general basis, for the provision of the service and to carry out the processing purposes described above, we may make use of authorised subcontractors acting on behalf of Fundación Telefónica, as data processors (e.g. internet service providers, software developers, data hosting and technical support providers, email providers, general service providers and digital or physical security service providers, etc.) and contractually subject to our instructions, only insofar as they are strictly necessary for the provision of the contracted services and only for the period of time strictly necessary for that purpose.

In those cases where it is necessary to disclose data to third parties, you will always be informed in advance. To this end, the breakdown of processing activities contained in this Policy indicates the cases in which your personal data will be disclosed to third parties.

In addition, in the event that there is a legal obligation or requirement to do so, we may disclose your data to the competent government authorities and agencies in accordance with said legal obligation or requirement and, where appropriate, also to other bodies such as the State Security Forces and Corps and the justice system.

International data transfers

Finally, you need to be aware that, when the authorised subcontractors acting on behalf of Fundación Telefónica or the above-mentioned recipients are located or process your data outside the European Economic Area, we will be making an international transfer of your data in accordance with the provisions of data protection law.

In general, we avoid making international transfers and your data is processed within the European Economic Area or in countries with an appropriate level of data protection in accordance with the Applicable Data Protection Regulation, but sometimes this cannot be avoided or is strictly necessary in order for you to benefit from the use of the Functionalities as described in the Terms of Use.

Furthermore, in the event that we do in fact conduct an international transfer of your data, we assure you that we will take such organisational, technical and contractual measures as may be necessary to ensure the protection and security of your data, such as, for example, signing the European Commission’s Standard Contractual Clauses with the authorised subcontractor or third-party transferee, carrying out impact assessments on the international transfer in question to assess the risk and take measures to mitigate it, encryption of data in transit or at rest, pseudonymisation of the data subject to the international transfer, and/or other additional or complementary measures to those set out herein.

7. WHAT RIGHTS DO YOU HAVE AS A DATA SUBJECT?

Your rights

As a User, or, where applicable, as a Visitor, data protection regulations grant you certain rights over your data which, depending on how they apply, you may exercise against Fundación Telefónica. Here’s what they are and how you can exercise them.

We also inform you that on the website of the Spanish Data Protection Agency (www.aepd.es) you can find more information on the characteristics of these rights and download templates for exercising each of them, although it is not necessary to use any template to exercise a right as faf as we are concerned.

Right to withdraw consent

This is your right to withdraw your consent to the processing of your data for the purposes that are legitimate on that basis, at any time and in an easy way.

Right of access

It is your right to ask us for details of the data we hold about you and how we process them, and to obtain a copy of them.

Right of rectification

It is your right to obtain the rectification of your inaccurate or erroneous data, as well as to complete incomplete data.

Right of erasure

It is your right to request the erasure or suppression of your data and information in certain circumstances. However, please note that there are certain occasions when we are legally entitled to continue to store and process your data, for example, in order to comply with a legal obligation to retain data.

Right of restriction

It is your right to restrict or limit the processing of your data in certain circumstances. For example, if you apply for erasure of data, but, instead of erasing it, you would prefer that we block it and process it only for retention purposes because you will need it later to make a complaint. Again, please note that there may be times when we are legally entitled to refuse your request for a restriction.

Right to object

It is your right to object to our processing of your data for a specific purpose, in certain circumstances provided for by law and related to your personal situation.

Right to portability

It is your right to ask us to receive your personal data in a structured, commonly used, machine-readable and interoperable format and to transfer it to another data controller, provided that we process your data by automated means.

The right to not be subject to automated individual decisions

This is your right to ask us not to subject you, in certain circumstances, to a decision based solely on automated processing of your data, including profiling, that produces legal effects concerning you or similarly significantly affects you.

Likewise, in general, mechanisms for the automated unsubscription of communications and other options for withdrawal of consent and opposition will be made available to the User and/or Visitor.

It is important to bear in mind that when you exercise a right, in some cases, you must clearly specify which right you are exercising and provide a copy of a document proving your identity. It should also be noted that some of the data processing is carried out by Fundación Telefónica in a way that does not require the direct identification of the Users, without Fundación Telefónica being obliged to obtain and/or process additional information to verify such User for the purposes of enabling the User to exercise his or her data protection rights.

In the event that a data subject exercises a data protection right and, due to the reasons indicated, Fundación Telefónica is not in a position to identify him or her in order to deal with the request, it will inform him or her to that effect if possible. Such a request shall be suspended until such time as the User provides additional information enabling him or her to be identified.

Any exercise of rights shall be answered within a maximum period of one month, which may be extended by two months if we need to do on a reasoned basis, taking into account the complexity of the request and the number of requests.

Finally, in the event that you do not agree with the way in which your data is handled by Fundación Telefónica, you have the right to lodge a complaint with the national supervisory authority by contacting the Spanish Data Protection Agency (AEPD, by its initials in Spanish), whose contact details are as follows:

8. HOW DO WE PROTECT YOUR PERSONAL DATA?

Fundación Telefónica is committed to guaranteeing the security, secrecy and confidentiality of your data, communications and personal information. Therefore, as part of our commitment and in compliance with the Applicable Regulations, we have adopted the most appropriate security measures and technical means to prevent their loss, misuse or unauthorised access.

When we receive personal data, we use rigorous procedures and security features to prevent unauthorised access. Thus, Fundación Telefónica has adopted the appropriate technical and organisational measures in its information system, complying with the principle of proactive responsibility and privacy by design, in order to guarantee the security and confidentiality of the data stored, and thus prevent their alteration, loss, unauthorised processing or access. All the above considering the current state of technology, the costs of implementation, and the nature, scope, context and purposes of the processing, as well as risks of varying likelihood and severity associated with each of the processing operations.

9. CHANGES TO THE PRIVACY POLICY

Fundación Telefónica also reserves the right to update this Privacy Policy at any time. Any such update will be made public by Fundación Telefónica, in any event, with such notice prior to its entry into force as is legally required.

In addition, it shall be communicated directly to the User where it affects his or her rights or freedoms or where, for example, the inclusion of a new processing activity would require the User’s consent.

Fundación Telefónica will retain your personal data for as long as you maintain your interest in participating in the Voluntarios Telefónica program unless you explicitly withdraw your consent.

The processing carried out by Fundación Telefónica will be legitimised by the provision of your express consent, obtained through the data collection form from which you have been referred to this privacy policy.

Are your personal data passed on to third parties?

Fundación Telefónica may transfer your personal data to third parties in order to manage your participation in a volunteering activity. Thus, your data may be transferred to collaborating entities of Fundación Telefónica to coordinate activities within the Telefónica Corporate Volunteering Program. If you are an employee of a Telefónica group company, Fundación Telefónica, Fundación ProFuturo, or any of the Telefónica Foundations existing in certain countries in the Americas, your data may be transferred to the corresponding People department of these entities to manage your participation in corporate volunteering activities.

Based on the above, international transfers of your personal data may occur. In any case, Fundación Telefónica will ensure that such transfers are carried out in accordance with the provisions of the GDPR and within the framework of guarantees established by said regulation.

Fundación Telefónica will not draw frames based on your personal data, nor will it make automated decisions based on their processing.

The processing carried out by Fundación Telefónica will be legitimised by the provision of your express consent, obtained through the data collection form from which you have been referred to this privacy policy.

The processing carried out by Fundación Telefónica will be legitimised by the provision of your express consent, obtained through the data collection form from which you have been referred to this privacy policy.

Why will Fundación Telefónica process your personal data?

Within the framework of the event in which you will participate as a speaker, organised by Fundación Telefónica, it will process your personal data (name and surname, ID card number or equivalent identity document) and your image rights, with reference to those photographs or audiovisual recordings taken by Fundación Telefónica during the course of the aforementioned event.

Your personal data will only be processed by Fundación Telefónica for the following purposes:

  • Name, surname and ID number, indicated in the corresponding authorisation document for the use of your personal data in favour of Fundación Telefónica, in order to manage your participation in the event.
  • Image, exclusively for the purpose of publicising your participation in the event, within the framework of the cultural activities organised by Fundación Telefónica, as well as the non-profit activities promoted by it, through internal or external media, including its own or third-party online platforms (YouTube, Instagram, Twitter, etc.) or any other currently known means of dissemination, with free access, or others whose access is limited to affiliated or registered users on paid platforms, specifically and solely and exclusively, the «Living Apps» of Movistar+.

In order to promote its general interest purposes, and the dissemination of the event in society, with the widest possible scope, Fundación Telefónica will keep your personal data until you express your opposition, limitation or suppression.

Fundación Telefónica will not draw frames based on your personal data, nor will it make automated decisions based on their processing.

The processing carried out by Fundación Telefónica will be legitimised by the provision of your express consent, obtained through the authorisation document for the use of your personal data, which will be signed by you prior to your participation in the event.

Are your personal data passed on to third parties?

Fundación Telefónica may transfer to third parties the images in which you appear, captured during the course of the event, or part of them, always within the scope and purposes of said event, and for the dissemination of Fundación Telefónica’s cultural activities and programmes. Under no circumstances will there be any international transfers.

Your data may also be transferred to third parties in those cases in which it is mandatory by virtue of any legal provision.

Fundación Telefónica will process the personal data you provide for the following purposes: to manage your participation in the «Digital Leaders» project, and the progress of your training within the framework of the same; and to keep you informed of all those activities and projects that Fundación Telefónica develops, within the scope of its general interest foundations.
